Thursday’s indictment marks the second time the Justice Department has unsuccessfully sought to prosecute James. Trump has vowed to retaliate against James, an elected Democrat, after her office filed a civil fraud case against him and his family’s business.

In November, U.S. District Judge Cameron McGowan Currie dismissed the mortgage fraud case against James after finding that federal prosecutor Lindsey Halligan, who prosecuted the case, was unlawfully appointed.
James insists the attempt to prosecute her was overtly political. On Thursday, she again said the charges against her were “baseless” and called for “an end to the uncontrolled weaponization of our justice system.”
Her lawyer, Abe Lowell, said any effort to continue the case would constitute a “shocking attack on the rule of law and a devastating blow to the integrity of our justice system.”
“The grand jury’s refusal to re-indict Attorney General James is a decisive rejection of a case that should never have existed,” Lowell said in a statement.
Despite the grand jury’s decision, federal prosecutors are reportedly still planning new indictments against James, Reuters reported, citing two unnamed sources.

Judge orders James to pay in 2024 after his office files civil lawsuit against Trump $450 million fine after it was discovered that he had fraudulently inflated his net worth to mislead lenders.
A New York state appeals court in August rejected that penalty but upheld a judge’s finding that Trump was responsible for the fraud.
Trump has repeatedly said the case is part of a political “witch hunt” against him, which also includes four witch hunts:fall Criminal cases that occurred after the first term.
James is one of three high-profile Trump critics to face federal criminal charges in recent months, along with former FBI Director James Comey and former Trump national security adviser John Bolton.
A case has also been brought against Comey, who led the investigation into alleged collusion between Trump’s 2016 campaign and Russia. Fired in late November Judge Currie cited Halligan’s equally illegal appointment.
