KSA has issued a notice to TOTO Online for the infringement action

The gambling authority of the Netherlands, known as the Kansspelautoriteit (KSA), issued a notice to TOTO Online for “violation of the Prevention of Money Laundering and Terrorist Financing Act.”

The regulator said that the company failed to continuously control the business relationships and their transactions, which should have happened after the initial investigation of the client.

“The statement says, among other things, that TOTO Online in some cases does not record clearly enough why new facts or events do not lead to the adjustment of the risk classifications of clients and why it requires some management measures. Also, the investigation of the origin of the money of the players is not enough,” said the KSA in a translated news release.

According to gambling authoritygambling providers are required to monitor gambling behavior and investigate it when necessary, such as sudden deposits of large amounts. The regulator has a Wwft Guideline published on the website, which focuses on risks such as high deposits, even if they come from the player’s own bank account.

TOTO Online was described as cooperating during the investigation, and some of the violations originally found were terminated before the instruction was made. They must end the violations within six months, and after this period, the KSA will conduct an audit.

The news release was published on December 24, with the regulator also sharing details of a different incident just a few days before (December 22) regarding LeoVegas. Previously the gaming authority announced that it had imposed a fine on LeoVegas because it did not sufficiently comply with the duty of care between the period of October 2023 and May 2024.

As a result, a €500,000 fine was imposed, after the KSA requested a large number of players’ files from the company and found that they were targeting non-compliance with the duty of care.
