A recently released video of a fatal beating at a New York prison shows prison officers repeatedly punching a handcuffed man, kicking him in the chest with a shoe, and lifting him up by the neck and dropping him.

Body camera footage of the Dec. 9 attack on Robert Brooks was released Friday by the state attorney general, who is investigating the use of force by police officers.

Brooks, 43, was pronounced dead at a hospital the morning after the attack at Marcy Correctional Facility, the Oneida County state prison where he was incarcerated.

Thirteen prison officers and a nurse involved in the attack will face dismissal, according to New York Gov. Kathy Hochul, who said she was “outraged and horrified” by the videos of the “senseless murder.”

A video released Friday shows prison officials repeatedly punching Brooks in the face and groin as he sits handcuffed on an examination table.

As one of the officers uses a shoe to kick Brooks in the stomach, the other pulls him by the neck and throws him back onto the table. The officers then remove the man’s shirt and pants while he lies on his back, motionless and bloody.

“These videos are shocking and disturbing, and I advise everyone to do their due diligence before choosing to watch them,” said New York Attorney General Letitia James.

Final results of Brooks’ autopsy are still pending.

Preliminary findings from the medical examiner point to “concerns of asphyxiation due to compression of the neck as the cause of death, and that the death was the result of the actions of others,” according to court filings.

Recently released CCTV footage shows prison officers at an upstate New York prison punching and kicking a handcuffed inmate before he died. The office of New York State Attorney Letitia James, who is investigating the incident, released the video on Friday.

‘Horrible and extreme’

The videos do not include sound because the officers wearing them did not activate their body cameras.

The state Department of Corrections, Prisons and Community Supervision issued a directive after Brooks’ death requiring staff to use body cameras in every interaction with inmates.

James said her office is investigating the use of force that led to Brooks’ death, but she did not say whether any of the officers will be charged with crimes.

With the release of the video, “members of the public can now see for themselves the horrific and extreme nature of the fatal attack on Robert L. Brooks,” said his family’s attorney, Elizabeth Mazur.

“As viewers can see, Mr. Brooks was fatally, violently beaten by a group of police officers whose job it was to protect him,” Mazur said. “He deserved to live, and everyone else who lives at Marcy Correctional Facility deserves to know that they don’t have to live in fear of violence at the hands of prison staff.”

“System problems”

The State Correctional Officers Union, which viewed the video of the attack before it was made public, said in a statement: “What we witnessed is incomprehensible, to say the least, and certainly does not reflect the great work that the vast majority of our membership does every day.”

“This incident not only endangers our entire membership, it undermines the integrity of our profession. We cannot and will not condone such behavior,” said the union, the New York State Police and Prison Officers Association.

As of 2017, Brooks was serving a 12-year prison sentence for first-degree assault. He arrived at Marcy Correctional Facility just hours before the beating, having been transferred from another nearby state prison, officials said.

Marcy is about 200 miles northwest of New York, between the cities of Rome and Utica.

The Correctional Association of New York, a prison watchdog group, said it documented reports of pervasive brutality and racism inside the Marcy Correctional Facility during an oversight visit two years ago.

The organization’s executive director, Jennifer Scaife, said the footage of Brooks’ beating was “distressing and horrifying, but not surprising” given previous revelations. She called on the state’s prison system to “address the systemic problems that allow such brutality to flourish.”

David Condliffe, executive director of the nonprofit Center for Community Alternatives, said in a statement: “For every case caught on camera, countless more acts of violence and murder in prisons are ignored, justified or covered up.

“Accountability must include, but cannot stop at, the dismissal of a few individuals. Their violence is not an anomaly; it is the product of a system steeped in impunity.”
