The man who allegedly attacked Rep. Ilhan OmarA Minnesota Democrat who was carrying a mysterious liquid later identified as apple cider vinegar will remain in custody until his trial after a judge deemed him a danger to the community.
Anthony James Kazmierczak, 56, appeared in court Tuesday, a week after he was accused of spraying the congresswoman with a syringe at Minneapolis City Hall.
Court-appointed defense attorney John Fosum noted that Kazmierchak was wearing a yellow jumpsuit, a color he told the court meant his client was being held in solitary confinement. He expressed concern about Kazmirchak’s mental state.
While Kazmierchak is not considered a flight risk, U.S. Magistrate Judge David Schultz ordered his continued detention to reduce risk to the community. The judge said the decision was based on the charges in Hennepin County. They include one felony count of terroristic threats and one count of fifth-degree assault.

Fossum said his client was in poor health and suffered from Parkinson’s disease and sleep apnea. He went on to argue that the “risk of harm” to Omar was “actually minimal” and said the liquid was relatively harmless.
Assistant U.S. Attorney Benjamin Bejar argued, however, that there was a risk of physical harm.
“Of course, that would have caused Rep. Omar’s eye injury,” Bejjar said. “We simply cannot allow protesters and people, no matter which side you belong to, to run up to deputies who are conducting their official business.”
During his arrest, Kazimierchak allegedly admitted to Minneapolis police that he had Spray vinegar on Omar.

When the alleged attack occurred, Omar was speaking out about immigration policy and calling for transparent investigations and legal action against U.S. Immigration and Customs Enforcement and the abolition of the agency. She also said that the Secretary of Homeland Security Kristi Noem Should resign or “face impeachment.”
After Kazimierchak allegedly sprayed Omar with liquid, Omar stood back for a moment, appearing shocked. After a brief pause, Omar continued speaking to the crowd for at least 10 minutes.
Kazmierczak has a criminal record, having been convicted twice of drunken driving in 2009 and 2010. Records show he served one day in jail for the 2010 conviction, followed by five years of supervised probation and 30 days of house arrest for the 2009 conviction.
